AbstractThis paper will deal with the question how European migration laws have impacted on the way African migrants and refugees enter the European Union. More in specific the paper focuses on refugees from the Horn of Africa who have been smuggled into the Netherlands. Lots is said about human smuggling, it is often linked to organised crime and there is a strong tendency to link it up with 'illegal' migration. However, how human smuggling is related to, and interacts with European migration policies itself is often overlooked. The increased crackdown on unsolicited migration has, instead of reducing irregular entries, strongly increased the involvement of human smugglers and the associated problem of migrant deaths.
